Federal rules (every state)
Chicken & other poultry
Under PL 90-492, a farmer who raises and slaughters up to 1,000 or up to 20,000 birds a year can sell them without inspection. The birds must be their own, healthy, and processed in clean conditions. The farmer can't buy or sell other poultry, must keep records, and can sell only inside their own state. Labels carry the producer's name and address, 'Exempt P.L. 90-492' and safe-handling instructions (Penn State Extension notes operations under 1,000 birds may not need these labels; check your state).
Eggs
The FDA Egg Safety Rule (21 CFR 118) covers farms with 3,000 or more laying hens, unless all eggs are sold directly to consumers. 21 CFR 101.17(h) requires this statement on untreated shell eggs: 'SAFE HANDLING INSTRUCTIONS: To prevent illness from bacteria: keep eggs refrigerated, cook eggs until yolks are firm, and cook foods containing eggs thoroughly.' Stores must hold eggs at 45°F or below (21 CFR 115.50).
Rabbit
Rabbits are not 'amenable' species, so federal inspection is not mandatory for them. FSIS offers voluntary, fee-based inspection (9 CFR Part 354). Without it, rabbit meat falls under FDA and state rules, so state law decides whether uninspected rabbit can be sold.
Fruit & vegetables
Farms are not covered by the FSMA Produce Safety Rule if produce sales average $25,000 a year or less over the last 3 years, adjusted for inflation ($34,324 for 2023–2025). The qualified exemption applies when total food sales are under $500,000 adjusted ($686,476) and more than half go to qualified end-users: consumers, or restaurants and stores in the same state or within 275 miles.
